TERMS AND CONDITIONS

1) Melbourne Express Pty. Ltd. A.C.N. 072 502 080, its agents, employees and contractors (herein referred to as “Melbourne Express”) reserve the right to refuse to carry any goods or provide any service without reason. All services provided by Melbourne Express will be subject to the terms and conditions listed.

2) The owner of the goods or authorised agent of the owner of the goods (herein referred to as “The Customer”) acknowledges that Melbourne Express must be advised of the quantity, description and nature of all goods consigned, specifically goods that are of a hazardous or dangerous nature.

3) The Customer must place all service bookings via the Melbourne Express booking number 1300 977 377 or by use of the website www.melbourneexpress.com.

4) The Customer authorises Melbourne Express to arrange the transportation and/or storage of goods and property with approved agents, employees and/or sub-contractors and via various methods to meet the specified service requirements.

5) The Customer authorises Melbourne Express to make any deviation from its normal routine as may be deemed reasonable.

6) Melbourne Express accepts no liability for any loss (including consequential loss) or damage to goods or property while in transit or storage (goods shall be considered in transit from point of loading on dispatch to point of unloading on delivery). It is the responsibility of The Customer to arrange insurance on goods while in transit or storage. Insurance can be provided by Melbourne Express at an additional cost when nominated by The Customer.

7) Melbourne Express shall be considered to have completed each booking or order at the point of delivery when a signature is obtained from the receiver or consignee on receipt of the goods or property.

8) At The Customers request and within 1 year of booking date, Melbourne Express will supply a receiver signature or proof of delivery at a nominal fee of $5.00 per booking or consignment.

9) Melbourne Express will make every reasonable attempt to contact the customer in the event of any inability to complete the service. Second-delivery, re-direction or return-of-goods will incur an extra booking charge.

10) The Customer agrees to pay a minimum cancellation charge of $7.00 and maximum cancellation charge of $30.00 in the event that a booking or order is cancelled on arrival and without prior notice by The Customer.

11) Melbourne Express rates include a reasonable allowance for loading and unloading time. The Customer agrees to pay waiting time at a rate of $7.00 per 10 minute increment when Melbourne Express is requested to wait at any point by The Customer.

12) Melbourne Express quoted rates does not include CityLink Toll charges. Were it is deemed necessary to use the CityLink Toll way for any job booking, The Customer agrees to pay the toll charges incurred by Melbourne Express plus a fee of $ 7.00 per individual job. 

13) Melbourne Express accepts payment for services by Credit Card (Master Card, VISA and Bankcard), Electronic Funds Transfer, Cash or Cheque (cheques made payable to Melbourne Express Pty Ltd). All prices quoted are pre GST, and GST will be applied to the final invoice total at 10%.

14) A variable fuel surcharge ( currently 12.8% based on $1.60 / lt ) will be applied to the total of the weekly Tax Invoice.

15) Melbourne Express reserve the right to alter quoted and advertised rates and services from time to time and without provision of any written notice to The Customer.

16) Melbourne Express may offer a credit account to approved Customers. In this event, The Customer agrees to provide Melbourne Express with two business credit references. The Customer gives authorisation to Melbourne Express to make inquiries as to the credit worthiness of the Customer.

17) The Customer agrees to make full and prompt payment to Melbourne Express for all work completed at agreed rates and strictly within the payment terms stated on the Tax Invoice. Strictly 14 days nett. Any request for alteration or credit of the Tax Invoice must be received prior to the due date for payment of the invoiced amount.

18) The Customer agrees to pay to Melbourne Express a credit cost recovery charge of $15.00 or equivalent to 2% per month as applied to the total balance of Invoice payments overdue and payments received later than the payment date specified on the Tax Invoice. A fee of $5 per invoice will be added to all accounts that require a manual invoice not generated by this web site.

19) The Customer agrees not to deal directly with any agent, employee or sub-contractor of Melbourne Express, nor solicit or endeavour to entice such agents, employees or sub-contractors to provide services directly.

20) In the event of a breach of item (18): The Customer agrees to provide one (1) months notice to Melbourne Express of any intention to employ directly the services of any agent, employee or sub-contractor of Melbourne Express. Once directly engaged, The Customer agrees to pay a selection and recruitment fee of $1500.00 per person to Melbourne Express as total compensation to Melbourne Express for loss associated with advertising and interviewing, selection and recruitment, induction and training.

21) ALL TERMS AND CONDITIONS ARE HELD AS BEING SUBJECT TO THE PROVISION OF THE TRADE PRACTICES ACT 1974 OR ANY COMMONWEALTH OR STATE LEGISLATION.
